剛拿回護照,三天前面籤透過的L1A。L1簽證適用於公司內部轉移,可以有公司集中申請(blanket petition),基本要求:1. 過去三年中在公司工作了一年以上;2. 公司在美國有運營實體。具體對公司有一些要求,就不細說了。具體而言,L1簽證又分L1A和L1B:L1A適用於管理人員,L1B適用於專業技術人員。申請時都要闡明工作職責和能力對公司而言是不可或缺,不能在美國招聘到替代人員,且工資高於平均水平。L1簽證申請人可以有移民傾向,家屬以L2簽證赴美可以工作。這兩種簽證的區別主要在於L1A申請綠卡時透過EB1C流程,不用再經勞工部審查就不用受配額限制去等幾年的排期,且簽證最長可以有七年;L1B申請綠卡則要走普通通道,簽證最長可達五年。根據自己的經驗,具體說一下L1A。一般介紹都說L1A適用於“高管”,其實要求沒那麼高。按USCIS說明,L1A適用於Executive or Manager,而一般的問題都在於Manager的定義,畢竟Executive在公司裡還是蠻明確的。根據法案8 CFR 214.2(l)(1)(ii)要求,Manager的職能要求有四點:(1) Manages the organization, or a department, subdivision, function, or component of the organization;(2) Supervises and controls the work of other supervisory, professional, or managerial employees, or manages an essential function within the organization, or a department or subdivision of the organization;(3) Has the authority to hire and fire or recommend those as well as other personnel actions (such as promotion and leave authorization) if another employee or other employees are directly supervised; if no other employee is directly supervised, functions at a senior level within the organizational hierarchy or with respect to the function managed; and(4) Exercises discretion over the day-to-day operations of the activity or function for which the employee has authority.
